Deposit Policy

ElefyMove is NOT a financial custodian. ElefyMove does not hold, insure, or guarantee the security deposit.

How Deposits Work on ElefyMove

  • At booking, the renter pays ElefyMove the first month's rent plus ElefyMove's fees (and VAT) — the security deposit is NOT included in this payment.
  • ElefyMove acts solely as the landlord's authorised payment collection agent for rent and fees (not as a custodian or trustee), and never collects, holds, or remits the security deposit.
  • At property handover / move-in, the tenant pays the security deposit directly to the landlord — ElefyMove is not involved in this payment.
  • The landlord then holds the security deposit for the duration of the tenancy under the terms of the rental contract.
  • At move-out, the landlord assesses the property and returns the deposit — less any legitimate deductions for damage beyond fair wear and tear — directly to the tenant.

ElefyMove's Role — Limitations

  • ElefyMove never collects, holds, or remits the security deposit at any point — it is paid tenant-to-landlord directly.
  • ElefyMove cannot compel a landlord to return a deposit.
  • ElefyMove does not insure or guarantee deposit returns.
  • ElefyMove does not decide outcomes for deposit deductions — the documented move-in/move-out record lets both parties settle directly.

Move-In & Move-Out Photo Inspections

ElefyMove's platform provides a structured photo inspection process at move-in and move-out. These photos are the primary evidence for any deposit disagreement and are accessible to both parties. Tenants are strongly encouraged to complete the move-in photo record on the platform immediately upon taking possession.

Deposit-Return Rating

ElefyMove displays a deposit-return rating for landlords based on verified reports from past tenants. This rating reflects individual tenant experiences and is not an ElefyMove guarantee or endorsement. Ratings are tied to completed tenancies and are subject to ElefyMove's Ratings Policy.

Governing Terms

The specific deposit amount, deduction criteria, and return timeline are set out in the rental contract signed by both parties on the ElefyMove platform. Thai law governs: under the 2025 Lease Contract Regulation B.E. 2568, the maximum total upfront amount for a monthly lease — security deposit plus advance rent combined — is 3 months' rent; for annual leases, up to 1 year's rent; for other arrangements, the contract applies.

Disagreements

If a deposit disagreement arises, contact [email protected] with your booking reference. ElefyMove is not a party to the deposit obligation; support will point you to the documented record (messages, condition photos) so both sides can settle directly. Tenants retain the right to pursue legal remedies through Thai courts or competent authorities.
